1. Offers, prices

My offers are in EURO and are subject to change without notice, errors excepted. The goods are subject to differential taxation in accordance with § 25 a UstG, so that no separate value added tax is shown.

The lots in my shop are usually only available once. Please make sure that you order enough spare parts.

 

2.Guarantee of authenticity

The offered single brands or sets were checked for authenticity and quality by me and correspond to their descriptions at the time of purchase. In addition, I guarantee the authenticity of all single stamps or sets delivered by me and commit myself for a period of 3 months from the date of invoice to take back if the buyer furnishes proof of a counterfeit when the delivered stamps or sets are returned. If possible, I will exchange or refund the full purchase price as well as the examination fees and postage costs. Further claims are excluded.

Collections, collective lots and large lots are expressly excluded from this guarantee, see also No. 5 (exchange, return).

 

3. Delivery

I deliver to known customers on account. I only deliver to new customers against advance invoice.

The delivery is made as a fully insured registered letter or parcel shipment.

The minimum order amount is 50,00 Euro. Shipments from a total invoice amount of 500,00 Euro are free of postage.

 

4.Payment

My invoices are due for payment after 8 days. For orders over 500,00 Euro invoice amount instalment payment can be agreed upon. Please contact me with confidence. Up to six monthly installments are possible without surcharge, the monthly installments should not be less than 150,00 Euro.

In the event of default in payment, I must charge default interest at a rate of 6 % above the respective ECB discount rate from the due date. In the case of an agreed instalment payment, the entire remaining claim shall become due immediately in the event of a delay in payment.

 

5. Exchange, return

You have the right to exchange or return goods for a period of one month from receipt of the consignment for single stamps or sentences, irrespective of the guarantee of authenticity according to No. 2. If possible and desired, it will be exchanged, otherwise the purchase price will be refunded.

Complaints of any kind, especially with regard to quality and quantity, are excluded for collections, collective lots or other large lots. Unless otherwise stated in the description, the catalogue values given are not binding.

Lots that are already described with errors cannot be claimed due to further minor defects. Errors resulting from the illustrations (cutting, perforation, stamping, etc.) cannot be the subject of a complaint. Any complaint is excluded if lots or brands have been changed. Changes include, in particular, removal of folds, folds or paper remnants, watering, treatment with chemicals, and application of all types of drawings.

 

6 Retention of title

The goods delivered by me remain my property until full payment. As long as the retention of title exists, resale, pledging or transfer of ownership by way of security is only permitted with my written permission.

 

7. Cancellation policy according to the Distance Selling Act

Right of revocation: You can revoke your contract explanation within one month without giving reasons in text form (e. g. letter, fax, e-mail) or, if the thing is left to you before the deadline, by return of the thing. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in case of recurring delivery of similar goods not before receipt of the first partial delivery) and also not before fulfilment of our information duties in accordance with § 312 c Abs. 2 BGB in connection with § 1Abs. 1,2 and 4 BGB-InfoV as well as our obligations according to § 312 e Abs. 1 sentence 1 BGB in conjunction with § 3 BGB-InfoV.

The timely dispatch of the revocation (or the goods) is sufficient to comply with the revocation period. The revocation must be addressed to: Phila Trade International, Volker Bettenbühl, Kastanienhain 24,65812 Bad Soden.

Consequences of revocation: In the event of an effective revocation, the services received by both parties are to be returned and any benefits (e. g. interest) that may have been drawn are to be surrendered. If you cannot return the received service to me in whole or in part or only in a deteriorated condition, you must pay me compensation for the value of the goods. This does not apply to the surrender of goods if the deterioration of the goods is exclusively due to their inspection, as it would have been possible in a retail shop. In addition, you can avoid the obligation to pay compensation for any deterioration caused by the intended use of the goods by not using the goods as if they were your property and by refraining from doing anything that could impair their value. Items that can be sent by parcel post are to be returned at our expense and risk. The costs of the return shipment are to be borne by you if the delivered goods correspond to the goods ordered and if the price of the goods to be returned does not exceed an amount of 40 euros or if, in the case of a higher price of the goods, you have not yet rendered the counter-performance or a contractually agreed partial payment at the time of the revocation. Otherwise, the return shipment is free of charge for you. Items that cannot be sent by parcel post will be collected from you. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation declaration or the goods, for us with their receipt.

8. place of fulfilment and jurisdiction

The place of performance and jurisdiction for both parties is Bad Soden, as far as legally permissible, otherwise the place of residence of the buyer.

Should one of the above provisions be invalid in whole or in part, the validity of the remaining provisions shall not be affected.
